Welcome to CashPoint Connect. These Terms of Use ("Terms") govern your access to and use of the CashPoint Connect platform, website, mobile applications, marketplace, and related peer-to-peer payment features (collectively, the "Service").

By registering an account, making a purchase, contributing to a payment pool, or using the Service in any capacity as a Customer or a registered Network Retailer, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Service.

Account Registration and Eligibility

Age Requirement: You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account and use the Service.

Account Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your profile updated.

Account Security: You are entirely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

Email Matching: Certain features, such as receiving and redeeming eGift Cards, require your CashPoint Connect account to be registered under the exact email address to which the gift was originally sent.

Digital eGift Cards

Issuance and Customization: Customers can purchase eGift Cards for eligible network retailers, specifying custom dollar amounts as permitted by the platform interface.

Redemption: eGift Cards are fully digital and can be redeemed for eligible purchases online or in-store at participating Network Retailers. eGift Cards are not credit cards, cannot be exchanged or redeemed for physical cash, and cannot be transferred to a different email address once claimed.

Expiration and Fees: Unless strictly prohibited by applicable local law, eGift Cards are subject to the specific expiration terms displayed at the time of purchase. CashPoint Connect does not charge maintenance fees on inactive card balances.

PayTogether Features (SharePay & GroupPay)

SharePay (Collect & Pay): The SharePay feature allows users to create a temporary group payment pool to instantly split bills (e.g., group dining) in real-time. By initiating or joining a SharePay pool, you authorize the platform to collect your designated contribution and immediately settle the total balance with the merchant on the spot.

GroupPay (Group Gifting): GroupPay allows multiple users to pool funds together to load an eGift Card up to a desired or custom milestone amount.

Contribution Visibility: When participating in a SharePay or GroupPay pool, your name, profile photo (if applicable), and funding status will be visible to other members of that specific group via a live contribution tracker.

Finality of Payments: All contributions made to a SharePay or GroupPay pool are final, non-refundable, and cannot be reversed once the transaction is processed or the card is generated.

Retailer Connect & Cinema Package (For Businesses)

Retailer Enrollment: Businesses joining the "Retailer Connect" network must provide valid business registration data and maintain a compliant profile on the CashPoint Connect Marketplace.

Quick Settlements: CashPoint Connect facilitates fast, secure settlements to retailers for network transactions, subject to standard processing fees agreed upon during business onboarding.

Retailer Cinema Package: Retailers opting into the Cinema Package grant CashPoint Connect a non-exclusive, worldwide, royalty-free license to display their business branding, promotional imagery, and advertisements on screens at participating local cinemas. Retailers are solely responsible for ensuring their advertisements comply with all local consumer protection and advertising laws.

Acceptable Use and Prohibited Activities

You agree not to use the Service to:

• Violate any applicable local, national, or international laws or regulations.
• Engage in fraudulent activities, money laundering, or the unauthorized collection/pooling of funds.
• Circumvent or attempt to circumvent the security measures, billing systems, or architecture of the platform.
• Use the Service to harass, abuse, or stalk other users, or use group message/custom eGift Card spaces to distribute defamatory or offensive content.

Termination of Service

We reserve the right, in our sole discretion, to suspend, restrict, or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms, harms other users, or infringes upon the operational integrity of CashPoint Connect. You may close your account at any time via the platform settings, provided all pending group balances, SharePay obligations, or retailer settlements have been cleared.

Limitation of Liability and Disclaimers

"As Is" Basis: The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

Limitation: To the maximum extent permitted by law, CashPoint Connect shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, goodwill, data, or transactional shortfalls resulting from merchant dynamic pricing.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Insert NSW, Australia, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the use of the Service shall be resolved exclusively through binding arbitration or the courts located within NSW.
